Vitória na Câmara: rejeitado o fim da avaliação dos cursos superiores
A Comissão de Constituição e Justiça e de Cidadania da Câmara dos Deputados rejeitou, na última quinta-feira, dia 19/11, o Projeto de Lei 2442/00, dos deputados Gilmar Machado (PT-MG) e Walter Pinheiro (PT-BA), que propunha a extinção da avaliação das instituições e dos cursos de nível superior e criação do Fórum Nacional de Educação – ambas competências do Ministério da Educação.
Em seu parecer, o relator e deputado Ciro Nogueira (PP-PI) argumentou que a proposta é inconstitucional, porque invade competências exclusivas do Poder Executivo. Segundo ele, a apresentação de projeto de lei sobre esse tema por parlamentar confronta-se com o princípio da separação dos Poderes. Pelo mesmo motivo, também foi considerada inconstitucional a emenda da Comissão de Educação e Cultura que havia aprovado a matéria.
A CONTEE comemora a decisão e ressalta a importância das iniciativas de avaliação da Educação Superior, em especial o instrumento de avaliação das instituições e dos cursos, elaborada sob critérios amplamente discutidos pela CONAES (Comissão Nacional de Avaliação da Educação Superior). Para a Confederação, o instrumento é essencial na complementação da aplicação do SINAES (Sistema Nacional de Avaliação da Educação Superior), principal ferramenta do Ministério para combater a má qualidade dos cursos de formação superior no País, assim como objeto fundamental para acompanhar os demais assuntos de interesse da comunidade acadêmica.
Tramitação
Como o parecer da CCJ por inconstitucionalidade é terminativo, a proposta será arquivada, caso não haja recurso para que ela seja votada pelo Plenário.
