Decisão da Justiça Federal não impede funcionamento de faculdade de medicina em PE
O Ministério da Educação (MEC) divulgou na semana passada que a Justiça Federal de Pernambuco havia determinado a suspensão das atividades da Faculdade de Medicina de Garanhuns (PE), mas a interpretação da sentença estava incorreta. A Agência Brasil republicou as informações passadas pelo MEC.
A juíza federal substituta Amanda Gonçalves Stoppa determina a suspensão das atividades da Fameg e condena a instituição a devolver o dinheiro pago pelos alunos pela inscrição no processo seletivo, matrícula e mensalidades, além de ressarcimento por danos morais. Mas, ao final da sentença, ela registra que os efeitos da decisão estão suspensos porque liminar julgada pelo Supremo Tribunal Federal (STF) já autorizou o funcionamento da faculdade na região.
A reportagem entrou em contato com a juíza Amanda que explicou que há uma divergência sobre a competência do julgamento. “A liminar do Supremo decidiu que a faculdade deve funcionar, mas não houve determinação para que o processo fosse impedido de tramitar aqui, por isso dei continuidade normal ao processo”, disse.
O Ministério da Educação informa, por meio de sua assessoria jurídica, que vai levar a decisão da juíza de Pernambuco ao Supremo e pedir a cassação da liminar. Segundo Amanda, caso a liminar seja cassada, as determinações dadas por ela em sua sentença passam a ter validade. “Mas enquanto houver ordem do STF dizendo que a faculdade pode funcionar, ela segue funcionando”, afirmou.
