Uniban é condenada a pagar indenização de R$ 40 mil a Geisy Arruda
A 9ª Vara Cível de São Bernardo do Campo (SP) condenou a Uniban (Academia Paulista Anchieta S/C) a pagar indenização de R$ 40 mil por danos morais a Geisy Arruda. A ex-aluna havia pedido ressarcimento de R$ 1 milhão à instituição.
Em outubro de 2009, a estudante alegou ter sido hostilizada por alunos da universidade ao utilizar vestido curto para assistir às aulas.
No mês seguinte, Geisy teria prestado depoimento em sindicância aberta pela instituição de ensino, que acordou com o retorno dela às aulas, e teria prometido garantir sua segurança.
Porém, Geisy teria tomado conhecimento de sua expulsão logo em seguida por divulgação em dois grandes jornais paulistas e também pela televisão em horário nobre, sob alegação de desrespeito à moralidade e à dignidade acadêmica.
A defesa da aluna entendeu que houve falha na prestação de serviço da Uniban, que culminou com a "violação dos direitos da consumidora, que sofreu agressões verbais e teve sua segurança pessoal colocada em risco".
Por sua vez, a Uniban alegou não ter causado qualquer dano à Geisy, afirmando que foi ela quem causou danos à empresa e que, além disso, teria arquitetado e executado um plano para adquirir notoriedade e conseguir vantagens após o episódio.
Em junho passado a Justiça ouviu nove testemunhas, entre alunos e funcionários da universidade. Na mesma ocasião, Geisy também foi ouvida.
De acordo com a decisão, "afigura-se razoável a importância de R$ 40 mil, quantia suficiente para compensar a violação sofrida pela autora, sem comprometer a saúde financeira da empresa ré."
Procurada pelo UOL Notícias, a Uniban disse que foi informada da decisão judicial e deve se pronunicar ainda nesta terça-feira, dia 5.
