Procurador-geral da República se posiciona a favor do piso salarial dos professores
O procurador-geral da República, Antonio Fernando Souza, emitiu na última quinta-feira (13/11) parecer contra a ação de inconstitucionalidade que contesta o piso nacional de R$ 950 para os professores (Lei nº 11.738/2008). Souza opinou pela extinção do processo, sem o julgamento do mérito, bem como pelo indeferimento do pedido de medida cautelar da ADI movida pelos governos do Mato Grosso do Sul, Paraná, Santa Catarina, Rio Grande do Sul e Ceará.
O parecer agora vai para o Supremo Tribunal Federal (STF) e deve ser examinado pelo relator da matéria, ministro Joaquim Barbosa. O piso salarial foi aprovado no Senado e sancionado pelo presidente Lula em junho deste ano.
Com a mudança no valor pago, a União deve entrar com uma parte dos recursos necessários em estados e municípios que não consigam garantir o pagamento dos R$ 950, com verbas do Fundo da Educação Básica (Fundeb), no valor de R$ 6 bilhões até 2010. No entanto, os governadores reclamam que esse valor provoca despesas exageradas aos estados, municípios e ao Distrito Federal, além de não ter sido previsto no orçamento.
Eles também questionam o fato de a lei determinar o pagamento retroativo a janeiro deste ano. Os mesmos questionamentos já foram feitos por instituições como o Conselho Nacional de Secretários de Educação (Consed) e a União Nacional dos Dirigentes Municipais (Undime).
Pontos referentes à jornada de trabalho e à carga horária para o desempenho das atividades de interação com os alunos também são contestados pelos governos estaduais.
O procurador-geral argumenta que a fixação do piso já estava prevista pela Emenda Constitucional 53, promulgada em 2003, e que por isso os entes federados deveriam estar preparados para cumprir a determinação legal. Também por conta dessa emenda, Antonio Fernando de Souza argumenta que os governadores não podem alegar falta de dotação orçamentária.
