A Pontifícia Universidade Católica (PUC) Campinas acaba de perder mais uma batalha no processo do 5 minutos, ingressado pelo Sinpro Campinas em 2003. O Tribunal Superior do Trabalho, em audiência nesta quarta-feira, dia 5, por unanimidade, não acolheu o recurso impetrado pela PUC-Campinas, além de manter integralmente a decisão de segunda instância que condenou a Universidade a pagar uma diferença salarial de 11,11% por ter aumentado a duração das aulas do período noturno de 45 para 50 minutos. A decisão do Tribunal Superior do Trabalho reafirma a decisão do TRT da 15ª Região Campinas de abril de 2006 e beneficia cerca de 600 professores.
A alteração das aulas ocorreu de forma unilateral em fevereiro de 2000 e deveria significar um reajuste salarial correspondente ao acréscimo no tempo trabalhado pelos professores.
A Reitoria e a Mantenedora da PUC Campinas foram alertados pelo Sinpro e Apropucc, mas preferiram delegar à Justiça a decisão. O resultado é este: a PUC deve aos seus professores 11,11% dos salários relativos às aulas noturnas no período de fevereiro de 2000 a junho de 2005 (data em que as aulas voltaram a ter duração de 45 minutos).
A Universidade ainda pode recorrer, mas tem poucas chances de reverter a decisão. Um recurso servirá apenas de manobra para retardar o pagamento aos professores do que lhes é devido.
Todos os professores que trabalhavam na Universidade naquela época (fevereiro de 2000 a junho de 2005), no período noturno estão incluídos no processo movido pelo Sinpro Campinas e serão convocados pelo Sindicato no momento oportuno e após a decisão final da Justiça.
