Os colégios Santa Maria, Porto Seguro, Nova Cachoeirinha e a Uninove foram denunciados ao Ministério Público do Trabalho por descumprirem a determinação de afastar imediatamente as professoras grávidas.

De acordo com notificação do MPT, todas as instituições de ensino devem transferir as gestantes do atendimento ao público ou de locais com aglomeração para áreas com menor risco de contágio da gripe A (H1N1). Se a transferência não for possível ou a professora utilizar transporte coletivo, a escola deverá dispensá-la do serviço, sem qualquer prejuízo de salário.

A decisão do Ministério Público do Trabalho de exigir o afastamento das professoras grávidas foi tomada depois de audiência com a Federação dos Professores do Estado de São Paulo (FEPESP), junto com o SINPRO-SP, realizada no último dia 19.
