Em julgamento ocorrido no dia 18/11, o TST reconheceu o direito de plano de saúde ao trabalhador aposentado por invalidez. As pesquisas de saúde realizadas no âmbito da CONTEE demonstram crescentes casos de doença profissional. São freqüentes as aposentadorias por invalidez. Importante a decisão do TST, do direito ao plano de saúde. Idéia também para as negociações coletivas, inserção de cláusula negocial assegurando esse direito (Processo TST -E-ED-RR - 4954/2002-900-03-00.9).

Trata-se de decisão da SDI-1, processo oriundo da Terceira Região (MG). Para o relator, Ministro Horácio, “a supressão do direito ao plano assistencial lesiona o princípio protetivo do artigo 468 da CLT”, segundo o qual, no contrato individual de trabalho, só é lícita a alteração das respectivas condições por mútuo consentimento, e desde que não resultem prejuízos ao empregado.

Programação para 2010
A Secretaria de Assuntos Jurídicos está preparando para agendar logo no reinício dos trabalhos em 2010 audiência com o Ministro Relator da ADIN/STF, questionando a inconstitucionalidade da exigência de comum Acordo. Na última audiência, foi juntada entrevista do Ministro Arnaldo Sucessekin favorável à inconstitucionalidade. As entidades serão convidadas a comparecer por meio de suas representações nas regionais e diretoria da CONTEE.

Outro agendamento que será feito na mesma ocasião, será visita ao Presidente do TST, levando reivindicações dos trabalhadores e visando estreitar relacionamento. Nessa visita pretendemos nos fazer acompanhar do Ministro José Luciano de Castilho Pereira, Coordenado do livro lançado pela CONTEE em 2008.
