O Colégio Batista Ágape assinou na última quarta-feira, dia 3 de março, um Termo de Ajustamento de Conduta, junto ao Ministério Público do Trabalho da 15ª Região, que vai garantir aos professores mensalistas da Instituição 15 minutos a mais na jornada diária, para compensar o tempo gasto com a marcação de ponto na entrada para as aulas. O Termo de Ajuste de Conduta foi fruto de denúncia apresentada pelo Sinpro de Campinas e Região.

O aumento da jornada diária em 15 minutos será também repassado nos salários dos professores mensalistas, que serão automaticamente reajustados. O Colégio Batista deverá também orientar os professores por escrito a respeito da efetiva jornada de trabalho e da necessidade de marcação de registro de ponto nos horários de entrada e saída do trabalho.

A escola se comprometeu a não realizar Banco de Horas, não exigindo desta forma dos professores a compensação dos horários de trabalho referentes às folgas que eventualmente forem concedidas nos dias pontes de feriado ou finais de semana.

Caso venha a descumprir o TAC a Instituição será multada em R$ 500,00 para cada trabalhador, sendo os valores revertidos ao Fundo de Amparo ao Trabalhador (FAT).

PLR

Na audiência o Sinpro cobrou ainda um posicionamento da escola a respeito do pagamento da PLR (Participação nos Lucros e Resultados) e pagamento das reuniões. A representante do Colégio Batista Ágape informou que como instituição filantrópica não tem fins lucrativos e que não teria que pagar PLR. O Sinpro reafirmou que a PLR é devida aos professores independente da escola ser filantrópica.

Quanto à remuneração pelas reuniões, foi dito que elas ocorrem individualmente e durante o horário de trabalho. O procurador do MPT não incluiu os dois pontos no TAC por considerar como cláusulas da Convenção Coletiva de Trabalho.
