Contribuição sindical: relator retira de pauta Adin do DEM, mas o tema volta
O relator da Ação Direta de Inconstitucionalidade (Adin) 4067, do DEM, que questiona o repasse da contribuição sindical às centrais sindicais, Joaquim Barbosa, retirou de pauta a ação, cuja votação estava prevista para esta quarta-feira (10).
A Adin já recebeu cinco votos - três favoráveis e dois contrários - , quando a votação foi interrompida, no dia 24 de junho de 2009, por pedido de vista do ministro Eros Grau. Cinco ministros ainda não votaram. Não há data definida para retomada da apreciação da ação do DEM.
O DEM requer a inconstitucionalidade dos artigos 1º, II e 3º da Lei 11.648/08, bem como dos artigos 589, II, "b" e seus parágrafos 1º e 2º e ao artigo 593 da CLT, na redação dada pela referida lei.
O partido afirma que "a contribuição sindical configura espécie de contribuição parafiscal, a constituir típica contribuição de interesse de categorias profissionais, sendo vedada sua utilização para o custeio de atividades que extrapolem os limites da respectiva categoria profissional".
Nessa linha, sustenta que, "afora o próprio Estado e as entidades expressamente referidas na Constituição, descabe à lei reconhecer a outras entidades - como as centrais sindicais - a condição de destinatárias imediatas de recursos tributários".
Alega, ainda, que referidos dispositivos impugnados conferem às centrais sindicais representatividade diversa das hipóteses previstas no artigo 8º da Constituição Federal.
Quem votou
Há três votos favoráveis à Adin. Do relator, ministro Joaquim Barbosa, e dos ministros Cezar Peluso e Ricardo Lewandowski que votaram parcialmente favoráveis à Adin, porém pela impossibilidade da destinação de parcela da contribuição sindical às centrais.
Os votos contrários são do ministro Marco Aurélio, que votou pela improcedência da Adin, e da ministra Cármen Lúcia, parcialmente favorável, mas concordando com a destinação de parte da contribuição sindical às centrais.
Quem falta votar
Para concluir o processo, faltam votar ainda os ministros Gilmar Mendes (presidente), Ellen Gracie, Carlos Britto, Eros Grau e Celso de Mello.
O ministro José Antonio Dias Toffoli está impedido de votar, pois se posicionou contrário à Adin quando era advogado-geral da União.
