A Câmara aprovou ontem projeto que obriga o Serviço Único de Saúde (SUS) a oferecer cirurgia plástica para mulheres que tenham sofrido lesões ou sequelas resultantes de agressão física. Pela proposta, os hospitais e centros de saúde, ao receberem as vítimas de violência, deverão informá-las da possibilidade de acesso gratuito, e o benefício será oferecido às vítimas que apresentarem o boletim de ocorrência da agressão.

A Comissão de Constituição e Justiça e de Cidadania (CCJ) aprovou, em caráter conclusivo, o substitutivo do deputado Valtenir Pereira (PSB-MT) ao Projeto de Lei 123/07, do deputado Neilton Mulim (PP-RJ). A proposta segue para o Senado.

Exigências
O substitutivo retirou do texto original a obrigatoriedade de o Poder Executivo se responsabilizar pela formação de equipes de especialistas em cirurgia plástica; pela distribuição de medicamentos durante os períodos pré-operatório e pós-operatório; e pelo controle estatístico dos casos de atendimentos. Segundo o relator, essa determinação é inconstitucional, porque viola o "princípio da separação dos poderes".

O texto, no entanto, mantém a exigência de que o médico que indicar a necessidade da cirurgia faça um diagnóstico formal e peça autorização ao responsável pela unidade de saúde respectiva para realizar a cirurgia.

Dignidade
Segundo Mulim, a maior parte das mulheres vítimas de agressão não possui condições sócio-econômicas para realizar tratamento em casos de sequelas, como cortes profundos e queimaduras. "O projeto procura, assim, devolver a dignidade à mulher lesionada e dar-lhe conforto psico-emocional", diz.

Antes de ser aprovado na CCJ, o projeto foi analisado pelas comissões de Seguridade Social e Família; e de Finanças e Tributação. Nessa última, a relatora, deputada Luciana Genro (Psol-RS), ressaltou que o projeto garante a amplitude de atendimento necessária, inclusive com a possibilidade de o SUS encaminhar essas mulheres a clínicas privadas.

Segundo ela, o fato de o projeto exigir um boletim de ocorrência para o atendimento hospitalar também pode ter impacto sobre as estatísticas de violência contra a mulher, uma vez que muitas mulheres não prestam queixas quando agredidas. "Para que a mulher tenha acesso à cirurgia, ela vai ter que denunciar essa agressão, ela vai ter que fazer a ocorrência. Então, os órgãos policiais, o Poder Judiciário, as instituições como um todo terão melhores condições de auferir os níveis de violência contra a mulher e também de combatê-la", acrescentou.
