Violência doméstica poderá ser apurada sem denúncia da vítima
Tramita na Câmara o Projeto de Lei 5297/09, da deputada Dalva Figueiredo (PT-AP), que altera a Lei Maria da Penha (11.340/06) para determinar que a apuração do crime de violência doméstica e familiar contra a mulher será feita independentemente de denúncia da vítima. Ou seja, o Estado terá que apurar a ocorrência e punir o agressor mesmo que a mulher não se disponha a denunciá-lo.
Em vigor desde 2006, a Lei Maria da Penha criou mecanismos para coibir a violência doméstica contra a mulher e prevê medidas de assistência e proteção às vítimas.
Em termos jurídicos, o projeto estabelece que o crime previsto na Lei Maria da Penha motivará uma "ação penal pública incondicionada". O objetivo da proposta, segundo a deputada, é modificar a compreensão de diversos juízes brasileiros, que estariam condicionando o julgamento do agressor à efetiva representação da vítima.
Em março passado, o Superior Tribunal de Justiça (STJ) decidiu que as vítimas de violência doméstica só têm a proteção do Estado se denunciarem pessoalmente o agressor. Para a deputada, decisões como essas vão contra o espírito da Lei Maria da Penha.
"Exigir que a mulher, para ver seu agressor punido, tenha que ir em juízo manifestar expressamente esse desejo somente contribui para atrasar ou mesmo inviabilizar a prestação jurisdicional, fragilizando as vítimas e desencorajando-as a processar o agressor", diz Dalva Figueiredo.
Ameaça e lesão leve
O projeto estabelece que a representação da mulher só será exigida nos casos de ameaça ou de lesões leves ou culposas. Nessas situações, a dispensa da representação só será permitida após audiência com o juiz da ação, antes do recebimento da denúncia, e desde que ouvido o Ministério Público.
Tramitação
O projeto tramita em caráter conclusivo nas comissões de Seguridade Social e Família; e de Constituição e Justiça e de Cidadania.
