A proposta altera a CLT, e seu relator, deputado Zenaldo Coutinho (PSDB/PA), ofereceu parecer pela constitucionalidade, juridicidade e técnica legislativa, sem entrar na análise de mérito. O texto vai ao exame do Senado.

A Comissão de Constituição e Justiça e de Cidadania da Câmara aprovou, nesta quinta-feira (17), a obrigação de o empregador indenizar o trabalhador, que for dirigente sindical, demitido sob alegação de justa causa, não reconhecida judicialmente.

A medida foi proposta pelo deputado Fernando Ferro (PT/PE) no PL 5.710/01.

A proposta altera a Consolidação das Leis do Trabalho (CLT), e seu relator, deputado Zenaldo Coutinho (PSDB/PA), ofereceu parecer pela constitucionalidade, juridicidade e técnica legislativa, sem entrar na análise de mérito.

Aprovado em caráter conclusivo, o projeto seguirá para análise do Senado, caso não haja recurso para que seja votado pelo plenário.

Custo de discriminar
De acordo com o projeto, a indenização será correspondente ao dobro da remuneração devida durante todo o período de afastamento, até a reintegração ou até o final do período de estabilidade provisória.
Segundo o autor, o projeto, na prática assegura estabilidade até um ano após o fim do mandato sindical, porque a indenização força a empresa a considerar o custo das atitudes discriminatórias.
A intenção do projeto é evitar que as empresas aleguem alguma falta grave para coibir a atividade sindical.
