Lula veta parcialmente Lei do Inquilinato

O presidente Luiz Inácio Lula da Silva vetou parcialmente a Lei do Inquilinato. Entre os itens vetados está o que determina concessão de liminar para desocupação do imóvel em 15 dias quando houver pedido de retomada em razão de melhor proposta apresentada por terceiros.

Também foi vetado o parágrafo que previa a concordância do proprietário do imóvel para a manutenção do contrato de aluguel em eventuais mudanças societárias do inquilino pessoa jurídica. A justificativa para o veto é de que “o contrato de locação firmado entre o locador e a pessoa jurídica não guarda qualquer relação de dependência com o a estruturação societária da pessoa jurídica locatária”.

Foi vetada ainda a aplicação imediata da lei, que não passa a valer a partir de hoje (10), data da publicação no Diário Oficial da União. A lei terá o prazo de 45 dias para entrar em vigor. A razão da extensão do prazo é dar tempo hábil para que as pessoas afetadas pelas normas conheçam o conteúdo do texto e estudem seus efeitos.

Em novembro, a relatora do projeto no Senado e líder do governo no Congresso, Ideli Salvatti (PT-SC), havia adiantado que os vetos já haviam sido negociados.
